Terms of Service

A. Scope and Parties

These Terms of Service ("Terms") govern the relationship between Wabacu, operating from aleja Solidarności 15, Białystok, Poland ("Wabacu", "we", "us") and any individual or organization ("Participant", "Client", "you") who enrolls in or purchases access to the Wabacu training program.

By submitting an inquiry, confirming enrollment, or making payment for any Wabacu program, you accept these Terms in full. If you are enrolling on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.

These Terms are governed by Polish law, in particular the Civil Code (Kodeks cywilny, Dz.U. 1964 Nr 16 poz. 93 as amended) and the Act on the Provision of Electronic Services (Ustawa o świadczeniu usług drogą elektroniczną, Dz.U. 2002 Nr 144 poz. 1204 as amended).

B. Program Description

The Wabacu training program is an educational service consisting of structured sessions focused on communication between non-technical managers and data or engineering teams. The program is delivered in three formats: open cohort, private cohort, and in-house delivery. The specific format, session count, delivery method, and schedule are confirmed in writing at the time of enrollment.

Program content is informational and educational in nature. Wabacu does not provide professional consulting, engineering, legal, or financial advice. The program does not confer any regulated qualification or professional certification.

We reserve the right to adjust program content, session structure, or delivery format where necessary, provided that the core curriculum and total session hours are not materially reduced.

C. Enrollment and Confirmation

Enrollment is confirmed when Wabacu issues a written confirmation to the Participant or Client following receipt of an inquiry and agreement on program format and pricing. For open cohorts, enrollment is confirmed upon receipt of payment. For private and in-house cohorts, enrollment is confirmed upon execution of a separate service agreement.

Wabacu reserves the right to decline enrollment at its discretion, including where the program is not considered an appropriate fit for the prospective participant's role or background.

Participants are responsible for ensuring they meet any prerequisites described in the program materials, including access to relevant work documents for use in exercises.

D. Payment Terms

Payment terms are specified in the enrollment confirmation or service agreement. For open cohort enrollments, payment is due in full prior to the first session. For private and in-house cohorts, payment terms are agreed separately and may include staged payments.

All prices are quoted in Polish Zloty (PLN) unless otherwise stated. Invoices are issued in accordance with Polish tax law (Ustawa o podatku od towarów i usług, Dz.U. 2004 Nr 54 poz. 535 as amended). VAT is applied where required by applicable law.

Late payments may result in suspension of access to program materials until outstanding amounts are settled.

E. Cancellation and Rescheduling

Cancellations by participants must be submitted in writing to [email protected]. The following conditions apply:

  • Cancellation more than 14 days before the first session: full refund of any payment made.
  • Cancellation between 7 and 14 days before the first session: 50% refund.
  • Cancellation less than 7 days before the first session: no refund, but the participant may transfer their place to another individual from the same organization.

Wabacu reserves the right to reschedule or cancel a session due to circumstances beyond our control. In such cases, participants will be offered an alternative date or a proportional refund. We are not liable for costs incurred by participants as a result of rescheduling.

F. Participant Conduct

Participants are expected to engage respectfully with trainers and other participants. Wabacu reserves the right to remove a participant from the program without refund where their conduct is disruptive, disrespectful, or otherwise incompatible with a productive learning environment.

Participants may not record sessions without prior written consent from Wabacu. Where session recordings are provided as part of the program format, these are for the personal use of enrolled participants only and may not be shared, distributed, or published.

G. Intellectual Property

All program materials, including workbooks, templates, exercises, slide decks, and session recordings, are the intellectual property of Wabacu and are protected under Polish and EU copyright law (Ustawa o prawie autorskim i prawach pokrewnych, Dz.U. 1994 Nr 24 poz. 83 as amended).

Participants are granted a non-exclusive, non-transferable license to use program materials for their own professional development. Reproduction, redistribution, or commercial use of any program materials without written permission from Wabacu is prohibited.

H. Limitation of Liability

The Wabacu training program is an educational service. We do not make any representations regarding specific outcomes for participants or their organizations. The application of program content to real-world situations is the responsibility of the participant.

To the extent permitted by applicable Polish law, Wabacu's total liability to any participant or client arising from or in connection with the program is limited to the amount paid by that participant or client for the specific program in question.

Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraudulent misrepresentation, or for any other liability that cannot be excluded by law.

I. Data Protection

Personal data collected in connection with enrollment and program delivery is processed in accordance with our Privacy Policy and applicable data protection law, including the GDPR and the Polish Act of 10 May 2018 on the Protection of Personal Data.

J. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Poland. Any disputes arising from these Terms or the provision of the program shall be subject to the exclusive jurisdiction of the courts of Białystok, Poland, unless mandatory consumer protection provisions in the participant's country of residence require otherwise.

Consumers resident in the European Union may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

K. Amendments

Wabacu reserves the right to amend these Terms at any time. Updated Terms will be published on this page with a revised "Last Updated" date. Continued enrollment or participation after the publication of amended Terms constitutes acceptance of those amendments. For existing enrolled participants, material changes to Terms will be communicated by email.
